Portuguese longer subject to spam by State fails to comply with the law - TeK.sapo

The Portuguese Association of Consumer Law (APDC) accuses the Portuguese State did not enforce the law to protect the unwanted email, known as spam. Since August 2012 a European directive that want added protection against unwanted emails, was transposed into Portuguese law, but the entity considers that the legal framework is “totally ineffective”.

At issue is the reception of unwanted publicity by individuals and companies, when they are created the legal conditions for the establishment of a National List of Not Receiving Communications Advertising for People Collective and lists managed by consent email marketing companies or their representatives, such as provided for in Law No. 46/2012.

The Director General of the Consumer is responsible for creating the list nationwide on legal persons, while the National Commission for Data Protection (NCDP ) and Anacom have responsibilities in the area of ??enforcement of violations of non-compliance with the law.

“The legislation passed in the National Assembly is not being met, or apply appropriate sanctions,” said the leader of the APDC, Susana Almeida, Lusa.

The APDC now wants to meet urgent with the Secretary of State, who has responsibility for this area of ??Consumer Rights, “to require full compliance with the law that protects rights of citizens and legal persons, “said the leader of the association.
